1. Heard the learned counsel for the parties.
2. This anticipatory bail application under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) has been preferred by the petitioner apprehending his arrest for offences registered under Sections 115 (2), 117 (2), 126 (2), 109 (1), 303 (2), 351 (2), 352 (2) and 324 / 3 of the Bharatiya Nyaya Sanhita.
3. Learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application to appear before the concerned Court to bring to the notice of the trial court that Section 109 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) is not attracted on the facts of this case, so far as the petitioner is concerned.
4. Thus, prayer is allowed.
5. Accordingly, this Anticipatory Bail Application is dismissed as withdrawn with a liberty to the petitioner to appear before the concerned Court. If the petitioner appears, the concerned Court will consider whether Section 109 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) is applicable so far as the petitioner is concerned, and thereafter, pass an appropriate order.
