Heard Sri Mayur D.Bhanu, learned counsel appearing for the petitioner, Sri N.Spoorthy Hegde, learned High Court Government Pleader appearing for respondents 1, 2 and 4 and Sri P.Prasanna Kumar, learned Special Public Prosecutor appearing for respondents 5 and 6. 4 3. Facts, in brief, germane are as follows: - 3.1. A crime in Crime No.91 of 2022 comes to be registered for offences punishable under Sections 302, 323, 392 read with 34 of the Indian Penal Code and for offence punishable under Section 3(2)(v) and 3(2)(va) of the Prevention of Atrocities Act 2015 (hereinafter referred to as 8the Act9 for short). The crime comes to be registered pursuant to a complaint by the petitioner on 18-12-2022. It is the case of the complainant/petitioner that he is working as Supervisor/Manager at Sarah Farms situated at Shivaji Village, Belthangadi Taluk owned by one A.C.Kurian. On 17-12- 2022 at about 5.30 in the evening the complainant is said to have heard a loud commotion and people shouting. Upon hearing the same, the petitioner is said to have come out of the farm and followed the voice where he is said to have seen Shreedhar, deceased employee of the farm and one K.L. Anand Gowda, Mahesh and others assaulting said Shreedhar. Upon seeing the petitioner, they said to have ran away from the spot. The petitioner/complainant is said to have taken said Sreedhar to the farm house and treated him and asked him to stay in the farm 5 house itself on that day. On the next day ie.., on 18-12-2022 in the morning around 6.30 p.m. when the petitioner went to the said place, said Shreedhar was not found and it is noticed that the accused persons had cut the fence, entered the farm house and killed Sreedhar and had thrown his body in the middle of the farm. Upon registration of the complaint on 18-12-2022, the Police recorded the statement of the petitioner and commenced investigation. 3.2. The investigation led to the Police filing a charge sheet not for offences punishable under Sections 302 and 392 or otherwise, but for offences punishable under Section 323, a non- cognizable offence. The petitioner who was the first informant of the incident that happened on 18-12-2022 is now drawn as accused in a separate crime on the score that he has misguided the police. Therefore, the petitioner is before this Court seeking re- investigation into the case in Special case No.60 of 2023 where the offences are now limited to the one punishable under Section 323 of the IPC and the provisions of the Act. 6 4.1. The learned counsel appearing for the petitioner Sri Mayur D.Bhanu would vehemently contend that the Police in a case which was for an offence punishable under Section 302 of the IPC 3 murder failed to arrest the accused persons on the same date. A post-mortem was conducted on the body and a final opinion of the report with regard to cause of death is kept pending for receipt of a toxicology report. Subsequent to registration of FIR when the Police of Belthangady Taluk failed to arrest the accused, huge protest cropped up as the deceased was belonging to Scheduled Tribe and Karnataka Dalitha Sangharsha Samithi has staged that protest. The department of Forensic Medicine and Toxicology replies to the queries of the Station House Officer observing that the deceased died due to cranio-cerebral injuries as result of blunt force trauma sustained to the head, which is most likely due to fall. The toxicology report was then submitted with regard to presence of alcohol and paraquat in the body. The final opinion of the postmortem report was presence of poison and alcohol in the stomach and small intestine which is suggestive of the fact that poison and alcohol was not absorbed into the systemic circulation. Based upon the report and the conduct of investigation, the Police 7 file a preliminary charge sheet not for offences under Section 302 or 392 of the IPC as was alleged at the time of registration of crime, but for offence punishable under Section 323 of the IPC and the provisions of the Act. The preliminary charge sheet was filed at the time when the Police were yet to collect CDR and CCTV footages. 4.2. It is the submission of the learned counsel that despite receiving the postmortem report indicating nature of injuries sustained and the toxicology report dated 17-01-2023, they were never produced along with the preliminary charge sheet. Therefore, he would submit that the investigating officer has misled the investigation. The petitioner then being aggrieved by the shoddy investigation, submits a representation for transfer of investigation to the Central Investigation Department (CID) by quoting all the lapses and lacunae in the investigation conducted by the jurisdictional police. On the request of the petitioner, the case was transferred to the CID on 08-09-2023. The Police then on 22-02-2025 filed additional charge sheet by drawing up accused No.4/Guruva as the accused in the case at hand. While so doing, 8 the petitioner was also drawn as accused No.5 by invoking the provisions of Section 195 and 203 of the IPC. It is his submission that the investigation has been completely misled by the Investigating Officer and, therefore, it has to be now transferred to the independent investigating agency. 5. Per contra, learned High Court Government Pleader appearing for respondents 1, 2 and 4 would submit that it is the petitioner9s complaint that has misled the investigation. The deceased had consumed poison and had fallen. Due to the fall he had blunt injuries around the skull and several injuries around the body. There was no case made out for offence punishable under Section 302 of the IPC. Therefore, the charge sheet was filed for offences punishable under Section 323 of the IPC and that of the Act. Additional charge sheet was filed after completing investigation and finding out that the petitioner himself has misled the investigation. He is now drawn as accused No.5 in the charge sheet. He would submit that the investigation is conducted by the CID and not by the jurisdictional Police. Therefore, no mala fides could be attributed to the 3rd respondent/investigating officer. The instances 9 quoted by the petitioner concerning denial of bail are of no avail, as the petitioner who is wanting to escape is now projecting that the investigation is shoddy and should be transferred to another investigating agency. He would seek dismissal of the petition. 6. I have given my anxious consideration to the submissions made by the respective learned counsel and have perused the material on record. 7. The afore-narrated facts are not in dispute. The entire issue triggered from registration of the complaint of an incident that happens on 18-12-2022. I, therefore, deem it appropriate to notice the complaint. This becomes a crime in Crime No.91 of 2022 for the offences punishable under Sections 302, 323, 392 and 34 of the IPC and Sections 3(2)(v) and 3(2)(va) of the Act. The Police began to conduct investigation. The investigation led to filing of preliminary charge sheet against the accused. The petitioner being aggrieved by the shoddy investigation, submitted a representation to the Chief Minister and the Home Minister seeking transfer of investigation. Respected Sirs, Sub: Request to order for Departmental enquiry on (1) Mr. Prathap Singh Thorat, Dy. Superintendent of Police, Buntwal Sub- Division, (2) Mrs. Ghana P Kumar, Dy. Superintendent of Police, DCRB, S.P. Office, D.K.District, Mangalore. I, Harish Mugera, S/o. Mr. Babu Mugera, resident of Belthangady is making this earnest appeal to your good selves seeking an order for a departmental enquiry into the acts of misdeeds, misbehaviour, misconduct, frauds played by the above 2 Deputy Superintendent of Police officials in the matter of conducting investigation in the murder case registered in Crime No. 91/2022 for offences punishable under sections 323, 302, 392 read with section 34 of the I.P.C. and sections 3 (2) (v) and 3 (2) (va) of SC/ST (POA) act on the file of Dharmasthala Police. 2. Sirs, I have personally seen the incident of assault on one Mr. Sridhara Mugera, a person belonging to SC/ST community on 17.12.2022 in the public road by the following 4 persons, namely, i) Mr. Thimmappa Poojaly ii) Mr. Lakshman Poojary iii) Mr. Mahesh Poojary, iv) Mr. K.L. Ananda Gowda 2. The said incident of crime was registered in Crime No. 91/2022 on the file of the Dharmasthala Police Station. The 14 Investigating Officer was one Mr. Prathap Singh Thorat. On account of the political pressures brought by the then M.L.A. Mr. Harish Poonja, of Belthangady Constituency, the Deputy Superintendent of Police, Mr. Prathap Singh Thorat, filed a false preliminary report dated 19.01.2023 to the 2nd Addl. Sessions Court Mangalore even without the same being called for by the court, to enable the above 4 accused persons to release on bail. Not only to release on bail, even the said Deputy Superintendent of Police has stated in his report that the accused are not involved in the offences punishable u/s 302 and 392 and accordingly, the offences were reduced to section 323 read with 34 of the I.P.C. and section 3 (2) (va) of SC/ST (POA) act. 3. In the post mortem report the Doctor has opined that it is a case of murder, but the Deputy Superintendent of Police, Mr. Prathap Singh Thorat, in his report dated 19.01.2023, has stated that it is not a case of murder and that it is a case of death by consumption of poison. Thereafter, about 3000 to 3500 members belonging to SC/ST community held a dharna in front of the Dharmasthala Police Station which compelled the Superintendent of Police to change the I.O. Accordingly, the investigation file was handed over to the present I.O. Mrs. Ghana P Kumar. Even the said I.O. bowing to the political pressure, did not conduct the investigation transparently, rather supported the accused. The accused were not sought for police custody for investigation. Material objects used for murder were not seized. 161 statements of the close family relatives of the accused were recorded with a malafide intention to benefit the accused for an order of acquittal. 4. Even the name of one of the accused, namely, Mr. Mahesh Poojary was removed from the preliminary charge sheet. When the bail application was moved by the accused, the Hon'ble Second Additional District & Sessions Judge Court, Mangalore, by her Order dated 07.02.2023, at para 13 to 16 has passed strictures against the I.O. and rejected the bail application. The subsequent IO Mrs.Ghana P Kumar filed a further false report and enabled all the accused to be released on bail. The court has taken serious note of the conduct of both the I.O.'s. I have already moved the Hon'ble High Court of Karnataka in WP No.4508/2023(GM-POLICE) to issue directions to the Government to handover the investigation file to C.I.D. 15 The members of SC/ST community have no confidence on both the I.O.'s. We have no confidence even on the Police Officials involved in the investigation. We want the investigation team to be changed and the same should be done by an impartial investigating agency like, C.I.D. The police are acting according to the tunes of the local M.L.A. who belong to the then ruling party. 5. Therefore, I kindly request you to order for a departmental enquiry on the misconduct, misdeeds, dereliction of duty, suppression of material facts, joining hands with the accused bowing to the political pressures of the local MLA, filing false report into the court and specially the findings of the Hon'ble First Additional Sessions Judge, referring the conduct of the I.O.'s pointed out at Para 13 to 16 of the Order dated 07.02.2023, passed in Crime No. 91/2022 on the file of the Dharmasthala Police Station. 6. It is then the petitioner has preferred the subject petition bringing in several lapses in conduct of a shoddy investigation. The lacunae that are projected by the petitioner are as follows: - (i) The petitioner contends that subsequent to registration of FIR the jurisdictional Police failed to arrest the accused due to which the protest had to erupt. (ii) After about two weeks from the date of death, the Police finally arrest 4 accused named in the statement by the petitioner before the concerned Court. The above tests have responded negative in pieces of liver, kidney, and blood. FINAL OPINION TO THE CAUSE OF DEATH ON PERUSAL OF AUTOPSY FINDINGS AND RFSL TOXICOLOGY REPORT I AM OF THE OPINION THAT: THERE IS PRESENCE OF POISON (PARAQUAT) AND ALCOHOL IN STOMACH AND SMALL INTESTINE AND ABSENCE OF POISON AND ALCOHOL IN LIVER, KIDNEYS AND BLOOD. The report is further suggestive of the fact of poison and alcohol not being absorbed into the system and has not shown any effect on the body. Therefore, alcohol and poison have not contributed to the cause of death. Notwithstanding the said postmortem report, the cause of death is shown to be due to poison, alcohol and a fall. This is the third lacunae. 8. On 19-01-2023, the police file a requisition, for dropping of the charges under Sections 302 and 392 of the IPC and Section 3(2)(v) of the Act, on the ground that there were no visible injuries found on the body of the deceased when the body was found at the 19 arecanut plantation. Contrary to the postmortem report, in the requisition, the cause of death is shown to be due to poison which was found in the stomach of the deceased and the injuries sustained were due to falling down which caused a big blow to the head. The presence of ethyl alcohol and herbicide is said to be the reason for death. The postmortem report, which was submitted prior to the filing of the requisition by the police, says otherwise. Therefore, what is to be looked into is not what the Police have drawn, but what the postmortem report would indicate. This is the fourth lacunae. 33 9. The next lacunae is when the Police filed the preliminary charge sheet for offence punishable only under Section 323 of the IPC, they were yet to collect CDR and CCTV footages. The police dropped accused No.4, while filing the preliminary charge sheet and after about 2 years filed additional charge sheet adding two more accused, one Guruva, the eye witness and the petitioner, the first informant, but charges under Section 302 and 392 remain to be dropped. This is the further lacunae. On 17-02-2025, it is the case of the petitioner that CDR records would indicate the presence of the accused around the deceased Shreedhar at the time of death. The details of CDR are appended to the petition. Despite this, the charge now remains to the offence punishable under Section 323 of the IPC, a non-cognizable offence and offence under the Act. The alleged murder now turns into a mere assault that too for a non- cognizable offence. The deceased dies. Postmortem report indicates that alcohol and poison are not the reason, but the Police say alcohol and poison are the reasons. Therefore, the matter would undoubtedly require re-investigation. 34 10. The re-investigation to be done by whom is the question. The case from the jurisdictional Police is already transferred to the CID. The CID has conducted a shoddy investigation, although prima facie the material such as postmortem report is also ignored and the reason for death is indicated as poison. Consumption of alcohol and blunt injury on the face which is said to be due to a fall are projected as reasons for the death, all of which are contrary to facts. But, every case cannot be entrusted to the CBI in the light of the judgment of the Apex Court in the case of ROYDEN HAROLD BUTHELLO v. STATE OF CHHATTISGARH1, wherein it is held as follows: <17. Having noted this aspect of the matter it is appropriate to refer to the decision in the case of State of West Bengal v. Before parting with the case, we deem it necessary to emphasise that despite wide powers conferred by Articles 32 and 226 of the Constitution, while passing any order, the Courts must bear in mind certain self- imposed limitations on the exercise of these constitutional powers. The very plenitude of the power under the said articles requires great caution in its exercise. Insofar as the question of issuing a direction to CBI to conduct investigation in a case is concerned, although no inflexible guidelines can be laid down to decide whether or not such power should be exercised but time and again it has been reiterated that such an 1 2023 SCC OnLine SC 204 35 order is not to be passed as a matter of routine or merely because a party has levelled some allegations against the local police. This extraordinary power must be exercised sparingly, cautiously and in exceptional situations where it becomes necessary to provide credibility and instil confidence in investigations or where the incident may have national and international ramifications or where such an order may be necessary for doing complete justice and enforcing the fundamental rights. Otherwise CBI would be flooded with a large number of cases and with limited resources, may find it difficult to properly investigate even serious cases and in the process lose its credibility and purpose with unsatisfactory investigations.= 18. Also Mithilesh Kumar Singh v. State of Rajasthan, (2015) 9 SCC 795 wherein it is held hereunder: <12. Even so the availability of power and its exercise are two distinct matters. This Court does not direct transfer of investigation just for the asking nor is transfer directed only to satisfy the ego or vindicate the prestige of a party interested in such investigation. The decision whether transfer should or should not be ordered rests on the Court's satisfaction whether the facts and circumstances of a given case demand such an order. No hard-and-fast rule has been or can possibly be prescribed for universal application to all cases. Each case will obviously depend upon its own facts. What is important is that the Court while exercising its jurisdiction to direct transfer remains sensitive to the principle that transfers are not ordered just because a party seeks to lead the investigator to a given conclusion. It is only when there is a reasonable apprehension about justice becoming a victim because of shabby or partisan investigation that the Court may step in and exercise its extraordinary powers. The sensibility of the victims of the crime or their next of kin is not wholly irrelevant in such situations. After all transfer of investigation to an outside agency does not imply that the transferee agency will necessarily, much less falsely implicate anyone in the commission of the crime. That is particularly so when transfer is ordered to an outside 36 agency perceived to be independent of influences, pressures and pulls that are commonplace when State Police investigates matters of some significance. The confidence of the party seeking transfer in the outside agency in such cases itself rests on the independence of that agency from such or similar other considerations. It follows that unless the Court sees any design behind the prayer for transfer, the same must be seen as an attempt only to ensure that the truth is discovered. The hallmark of a transfer is the perceived independence of the transferee more than any other consideration. Discovery of truth is the ultimate purpose of any investigation and who can do it better than an agency that is independent. 13. Having said that we need to remind ourselves that this Court has, in several diverse situations, exercised the power of transfer. In Inder Singh v. State of Punjab this Court transferred the investigation to CBI even when the investigation was being monitored by senior officers of the State Police. So also in R.S. Sodhi v. State of U.P. investigation was transferred even when the State Police was doing the needful under the supervision of an officer of the rank of an Inspector General of Police and the State Government had appointed a one-member Commission of Inquiry headed by a sitting Judge of the High Court to enquire into the matter. This Court held that however faithfully the police may carry out the investigation the same will lack credibility since the allegations against the police force involved in the encounter resulting in the killing of several persons were very serious. The transfer to CBI, observed this Court, <would give reassurance to all those concerned including the relatives of the deceased that an independent agency was looking into the matter=. 14. Reference may also be made to the decision of this Court in State of Punjab v. CBI wherein this Court upheld the order transferring investigation from the State Police to CBI in connection with a sex scandal even when the High Court had commended the investigation conducted by the DIG and his team of officers. In Subrata Chattoraj v. Union of India, this Court directed transfer of the Chit Fund Scam in the States of West Bengal and Orissa from the State Police to CBI keeping in view the involvement of several influential persons holding high positions of power and influence or political clout. 37 15. Suffice it to say that transfers have been ordered in varied situations but while doing so the test applied by the Court has always been whether a direction for transfer, was keeping in view the nature of allegations, necessary with a view to making the process of discovery of truth credible. What is important is that this Court has rarely, if ever, viewed at the threshold the prayer for transfer of investigation to CBI with suspicion. There is no reluctance on the part of the Court to grant relief to the victims or their families in cases, where intervention is called for, nor is it necessary for the petitioner seeking a transfer to make out a cast-iron case of abuse or neglect on the part of the State Police, before ordering a transfer. Transfer can be ordered once the Court is satisfied on the available material that such a course will promote the cause of justice, in a given case.= 19. The above-noted decisions are in fact cited by the learned Senior Counsel for the appellants to contend that this Court should exercise its extraordinary power to refer to the matter to CBI in the instant facts. In that regard, it is also necessary to note that the High Court on the other hand has referred to the various decisions on the said aspect and has also taken into consideration the recent decision in the case of Arnab Ranjan Goswami v. Union of India, (2020) 14 SCC 12 wherein the entire aspect has been crystalized and this Court has held that the power to transfer an investigation must be used sparingly. The relevant portion reads as hereunder: - <52. In assessing the contention for the transfer of the investigation to CBI, we have factored into the decision-making calculus the averments on the record and submissions urged on behalf of the petitioner. We are unable to find any reason that warrants a transfer of the investigation to CBI. In holding thus, we have applied the tests spelt out in the consistent line of precedent of this Court. They have not been fulfilled. An individual under investigation has a legitimate expectation of a fair process which accords with law. The displeasure of an accused person about the manner in which the investigation proceeds or an unsubstantiated 38 allegation (as in the present case) of a conflict of interest against the police conducting the investigation must not derail the legitimate course of law and warrant the invocation of the extraordinary power of this Court to transfer an investigation to CBI. Courts assume the extraordinary jurisdiction to transfer an investigation in exceptional situations to ensure that the sanctity of the administration of criminal justice is preserved. While no inflexible guidelines are laid down, the notion that such a transfer is an <extraordinary power= to be used <sparingly= and <in exceptional circumstances= comports with the idea that routine transfers would belie not just public confidence in the normal course of law but also render meaningless the extraordinary situations that warrant the exercise of the power to transfer the investigation. Having balanced and considered the material on record as well as the averments of and submissions urged by the petitioner, we find that no case of the nature which falls within the ambit of the tests enunciated in the precedents of this Court has been established for the transfer of the investigation.= 20. Hence it is clear that though there is no inflexible guideline or a straightjacket formula laid down, the power to transfer the investigation is an extraordinary power. It is to be used very sparingly and in an exceptional circumstance where the Court on appreciating the facts and circumstance arrives at the conclusion that there is no other option of securing a fair trial without the intervention and investigation by the CBI or such other specialized investigating agency which has the expertise.= (Emphasis supplied) The Apex Court holds that if there is no option of securing a fair trial without the intervention and investigation by the CBI, the matter should be entrusted to the CBI, which power should be sparingly exercised. 39 11. In that light, finding that the investigation conducted is absolutely shoddy, I direct re-investigation to be done in the case at hand, not by the hands of the CBI or the CID which has already done, but at the hands of the Special Investigation Team to be constituted for the purpose, so that a fair trial emerges. The Special Investigation Team shall also look into the fact whether the petitioner has misled the investigation or otherwise. 12. For the foresaid reasons, the following: O R D E R (i) Writ Petition is allowed. (ii) The 1st respondent/State shall constitute Special Investigation Team (8SIT9) of appropriate Officer for re- investigation or further investigation with respect to Crime No.91 of 2022 within 4 weeks from the date of receipt of a copy of this order. (iii) After constitution of SIT, it shall take over the investigation, conduct the same and file its final report before the concerned Court within 4 months from the date of its commencement. 40 (iv) Till the SIT files its final report, further proceedings in Special Case No.60 of 2023 shall remain stayed. Once the report is placed before the concerned Court by the SIT, the concerned Court shall proceed further regulating its procedure. Consequently, I.A.No.1 of 2025 also stands disposed.
