Neutral Citation No. - 2025:AHC:70876-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 8766 of 2025 Petitioner :- Jaichandra And 13 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Alok Ranjan Tripathi Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J. 1. Heard learned counsel for the petitioners, learned A.G.A. for the State-respondents and Shri Mukesh Kumar Pandey, learned counsel for the informant. 2. Present writ petition has been preferred for quashing the First Information Report dated 03.04.2025 registered as Case Crime No. 0050 of 2025, under Sections 190, 191(2), 193(3), 131, 115(2), 109(1), 117(2), 352, and 351(2) of B.N.S., 2023 at Police Station- Shivrajpur, District Kanpur Nagar and for a direction to respondents not to arrest the petitioners pursuant to impugned FIR. 3. Considering the facts of the case, as it cannot be disputed that the alleged incident has not occurred as various grave injuries have been sustained by both the parties, we do not find any merit to entertain the writ petition for quashing of the impugned FIR. 4. Once the court has declined to quash the impugned first information report, learned counsel for the petitioners states that the petitioners do not want to press the writ petition and the same may be dismissed as not pressed and leave may be accorded to invoke the remedy as available in law. 5. With the aforesaid leave, the writ petition is dismissed as not pressed. Order Date :- 5.5.2025 NLY (Anil Kumar-X,J.) (Mahesh Chandra Tripathi,J.)
