1. This is the second bail application of the applicant which has been arrested on 27.05.2024 in connection with Crime No. 372/2024, registered at Police Station, Sirgitti, District Bilaspur for the offence punishable under Section 302, 336, 427 and 34 of IPC.
2. The first bail application of the applicant has been dismissed on merits vide
order dated 31.07.2025 passed in MCRC No. 4580/2025.

Learned counsel for the applicant would submit that after rejection of the first bail application of the applicant, the co-accused Sachin Sonwani has been granted bail by the Hon’ble Supreme Court vide order dated 11.07.2025 passed in SLP(Crl.) No. 8289/2025. 2 antecedents. However, out of seven criminal antecedents against the applicant, the applicant has been convicted in Crime No. 380/2021, registered at Police Station Sirgitti, Bilaspur for the offence under Section 3 of the Public Gambling Act, 1867 and Crime No. 362/2019 registered at Police Station Sirgitti, Bilaspur under Section 3 of Public Gambling Act, 1867 and sentence for fine only. With respect to the Crime No. 411/2020 registered at Police Station Sirgitti, Bilaspur for the offence under Section 147, 148, 294, 506, 323 and 452 of IPC, its record is not traceable, therefore, he could not state about its status. With respect to the Crime No. 233/2017, registered at Police Station Sirgitti, Bilaspur for the offence under Section 279, 337 and 338 of IPC and Section 3/181 of Motor Vehicles Act,1988, are related with the Motor Vehicles Act, 1988, and he has been sentenced for fine only. 4. He would further submits that Crime No. 150/2019 registered at Police Station Sirgitti, Bilaspur under Section 294, 506, 323 and 327 of IPC is shown as disposed of in the official website of the Principal District and Sessions Court, Bilaspur. However, it could not be ascertained as to whether the applicant has been acquitted or convicted in this offence. He would further submits that the offence which relates to Crime No. 324/2024 registered at Police Station under Section 457 and 380 of IPC and Crime No. 243/2022, registered at Police Station Sirgitti, Bilaspur under Section 457, 380, 411, 34 of IPC, the trial in both these cases are still pending. He would further submits that the applicant is in jail since 27.05.2024, and final adjudication of the case will take its own time, the co-accused Sachin Sonwani has been granted bail, therefore, the present applicant may also be released on bail. 5.
On the other hand, learned counsel appearing for the State opposes and submitted that the first bail application of the applicant has been dismissed on merits and there are criminal antecedents against the applicant and trial of two offences are still pending, therefore, he is not entitled for bail. 3

Considering the submissions made by learned counsel for the parties, considering the nature of offence, further considering that the first bail application of the applicant has been rejected by this Court on 31.07.2025, after considering the merits of the case as well as his criminal antecedents, further considering that out of seven criminal antecedent, two cases against the applicant are still pending and trial that case are going on, I do not find any change in circumstance to release the applicant by allowing his second bail application. 7. Accordingly, his second bail application is rejected. 8. However, considering the detention period of the applicant that he is in jail since 27.05.2024 and till date only three witnesses have been examined before the learned trial Court as submitted by the learned counsel for the applicant, the learned trial Court is directed to expedite the trial of the case.
