This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.121/2025 registered at Police Station – City Kotwali, Baloda-bazar, District – Baloda-Bazar (C.G.) for the offence punishable under Sections 308(7), 318(4) of the BNS, 2023. 2. As per prosecution story, in brief, is that on 15.01.2025, the complainant lodged a written complaint in police station City Kotwali Balodabazar stating therein that she received a call on her mobile VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.10.31 10:56:21 +0530 2 wherein she was informed that her credit card balance is due, upon this complainant replied that she has no connection with that account. That person on the said that he would lodge a complaint against her and connected her call with the police and said that her name was involved in the money laundering case and sent her a copy of the Supreme Court warrant via whatsapp and she was asked to deposit the money would be returned after inquiry within 24 hours. The complainant was threatened and thus she transferred a total of Rs. 3,48,000/- in different accounts though different transactions. Thereafter, aforesaid offences have been registered against the applicant. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He further submits that there is total 10 prosecution witnesses, out of which 4 have turned hostile, including the complainant. The present applicant is in jail since 26.03.2025 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel, opposes the bail application and submits that applicant has been found to be involved in the commission of the crime in question along with co-accused persons. She further submits that bail application filed by the co- accused persons has also been rejected by this Court in MCRC No.3161 of 2025 vide common order dated 20.05.2025, therefore, instant bail application filed by the present applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature and gravity of the offence and the material available on record and also considering the fact that bail application filed by the co-accused persons has also been rejected by this Court in MCRC No.3161 of 2025 vide common order dated 20.05.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail. 7. Accordingly, this second bail application of applicant – Bhola @ Rohit Kumar Singh involved in Crime No.121/2025 registered at Police Station – City Kotwali, Baloda-bazar, District – Baloda-Bazar (C.G.) for the offence punishable under Sections 308(7), 318(4) of the BNS, 2023., is rejected at this stage. 8.
