The grievance of the petitioner in the present petition is that some resolution of Kshetra Panchayat, Vikas Khand, Lotan, District- Siddharth Nagar is not genuine and the resolution has been forged for the purpose of giving illegal monetary benefits to the Chairman of the Kshetra Panchayat and other persons. It has been stated in the writ petition and in the representation filed by the petitioner before the Block Development Officer that an amount of Rs.30,00,000/- has been embezzled by the Chairman and other persons as a consequence of the aforesaid resolution. 2. The petitioner has the remedy to approach the District Magistrate, Siddharth Nagar, who may exercise his powers u/s 226 and 228 of U.P. Kshetra Panchayat and Zila Panchayat Adhiniyam, 1961 read with Section 236 of the Act, 1961. 3. In view of the aforesaid, the petition is disposed of directing that in case the petitioner files an application before the District Magistrate, Siddharth Nagar, bringing all the necessary facts to his notice, the District Magistrate or any other person authorized on his behalf as permissible u/s 236 of the Act, 1961 shall enquire into the same and appropriate action shall be taken preferably within a period of three months from the date of filing of application before the District Magistrate.
