Sai Nagar, Nalanda School Backside, Rajampeta Town and Mandal, Annamaya District, Andhra Pradeshwere detained for the past 1 day without the registration of any crime or any reason or justification. The said actions are arbitrary, illegal, and violative of Articles 14,19, 21 and 22 of the Constitution of India and consequently direct the respondent police authorities to produce the detenues before this Hon'ble Court forthwith and to pass Counsel for the Petitioner: 1. THE ADVOCATE GENERAL The Court made the following: 3 (CMR,J & TCDS,J W.P.No.29770 of 2025) ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) This Writ Petition for Habeas Corpus is filed under Article 226 of the Constitution of India by the petitioner alleging that his parents were illegally detained by the 3rd respondent–Deputy Superintendent of Police, Rajampet, Annamaiah District, and seeking declaration that such detention is illegal and consequential direction for their release. 2. The petitioner has moved Lunch Motion today, which was permitted. 3. At the time of hearing, on advance notice, the learned Assistant Government Pleader attached to the office of the learned Advocate General submitted, on instructions, that a crime was registered against the father of the writ petitioner, one Tamidhapati Murali, on a report lodged by the de facto complainant, G. Vishnu Vardhan Naidu, in Crime No.300 of 2025 of Rajampet Police Station, for the offences punishable under Sections 61(2), 55, 56, and 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, and that notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS') was issued to him and thereafter he was released. 4. The learned counsel for the petitioner also submits that the Station House Officer, Rajampet Police Station, issued notice to the corpus under Section 35(3) of the BNSS in the above crime and thereafter released him. 4 (CMR,J & TCDS,J W.P.No.29770 of 2025) 5. In that view of the matter, the grievance of the petitioner stands adequately redressed. 6. Recording the aforesaid submissions made by the learned counsels on either side, the Writ Petition is closed. There shall be no order as to costs.
