Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 2. 3. A learned Single Judge of this Court in Crl.P.No.2624 of 2025 while enlarging other Accused on bail dismissed bail applications of Accused Nos.2 & 4 on the ground that there were specific overt acts attributed against them. From the date of dismissal of the first bail application till the date of filing of second bail application there is a change of circumstance. After completion of further investigation, the Investigating Officer has filed chargesheet. L.W.1 suffered grievous injury. There is a counter case lodged by one of the accused in Crime No.1 of 2025 and that counter case was registered as case in FIR No.2 of 2025 of Gudur Police Station. 4. In a case and counter case which arise out of same transaction and on the same date and time and place, it is the bounden duty of the Investigating Officer to find out who are aggressors. Indeed, there is no finding in the chargesheet by the Investigating Officer who is the aggressor of the offence. In a judgment relied on by the learned Assistant Public Prosecutor, the Hon’ble Apex Court in Ananda Babu v. State of T.N.,^ at paragraph No.6, it is held that successive anticipatory bail applications are not to be entertained 5. (2021) 16 see 725 8 3 and more so, when the case dairy and the status report clearly indicated that Accused was absconding and not cooperating with the investigation. In the instant case investigation has been completed and chargesheet has been filed. Therefore, considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioners, this Court is inclined to grant pre-arrest bail to the Petitioners/Accused Nos.2 & 4. In the result, the Criminal Petition is allowed with the following 6. 7. conditions: In the event of arrest of the Petitioners/Accused Nos.2 & 4, they shall be enlarged on bail subject to them executing a self-bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. I. The Petitioners/Accused Nos.2 & 4 shall make themselves available for investigation as and when required. The Petitioners/Accused Nos.2 & 4 shall not cause any threat, inducement or promise to the prosecution witnesses. The Petitioners/Accused Nos.2 & 4 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. IV. The Petitioners/Accused Nos.2 & 4 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. V. The Petitioners/Accused Nos.2 & 4 shall surrender their passports, if any, to the investigating officer. If they claim that VI. 4 they do not have passport, they shall submit an affidavit to that effect to the Investigating Officer.
