The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.0284/2025, registered at Police Station Mohan ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.10.17 21:01:45 +0530
2 Nagar, Durg District Durg (C.G.) for alleged commission of offence punishable under Section 109(1) of BNS.

As per the case of the prosecution, Dr. Shailendra Kumar Mandal, Medical Director of Arogyam Hospital, Kadambari Nagar, lodged a report at Police Station Mohan Nagar stating that staff member Divya Kosre had complained about Shekhar Tandi dirtying the bathroom. Agitated by this, on 24.06.2025 at around 16:15 hrs, Shekhar Tandi entered into a heated argument with Divya Kosre over bathroom cleanliness and attacked her with the coil rod of an auto-cleave machine kept in the CSSD room with intent to kill. As a result, Divya sustained serious head and wrist injuries and was admitted to the ICU in critical condition. On this report, Crime No. 284/2025 was registered at PS Mohan Nagar under Section 109(1) IPC, and the matter was taken up for investigation. Medical examination confirmed serious injuries, the weapon (coil rod) was seized from the spot, and the victim’s statement is yet to be recorded. Hence, the bail application.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present applicant. He further submits that the alleged incident arose out of a minor and spontaneous quarrel between two staff members over a trivial issue, amounting at best to a petty altercation without any criminal intent. The injured, Ms. Divya Kosre, has herself submitted an affidavit before the Superintendent of Police, Durg, stating she has no grievance against the applicant, did not lodge any
3 complaint, and that the incident was purely accidental without any deliberate or malicious intent. Even on the face of the allegations, no element of criminal intention can be attributed to the applicant. Hence he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that during a quarrel over bathroom cleanliness at Arogyam Hospital on 24.06.2025, present applicant attacked staff member Divya Kosre with a coil rod of an auto-cleave machine with intent to kill, causing serious head and wrist injuries, further the Medical examination confirmed the grievous injuries sustained by the injured, therefore, the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the nature of allegation made against the present applicant that present applicant got into an argument with Divya / injured over bathroom cleanliness and allegedly attacked her with the coil rod of an auto-cleave machine kept in the CSSD room with intent to kill, as a result of which, injured sustained head and wrist injuries and was admitted in the ICU, due to her critical condition and from perusal of Medical examination report of the injured, it appears that she sustained multiple injuries i.e. selling over head in parietal region and
4 swelling over hand, further as pe CT Head Report, soft tissue injury is found and as per X-Ray Hand Report injury in 4th metacarpal bone is found and as per opinion of doctor, the injuries are found to be grievous in nature, as such, I am not inclined to grant anticipatory bail to the applicant. 7.

Accordingly, the anticipatory bail application of the applicant - Shekhar Tandi, involved in Crime No.0284/2025, registered at Police Station Mohan Nagar, Durg District Durg (C.G.) for alleged commission of offence punishable under Section 109(1) of BNS is rejected.
