------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH
----- For the Petitioner : Mr. Amit Kumar, Advocate For the State
: Mr. Shree Prakash Jha, A.P.P.
--- 02/27.02.2025
Heard the parties.
The petitioner has been made accused in connection with Karra P.S. Case No.59 of 2024, corresponding to G.R. Case No.426 of 2024, for the offences registered under Sections 414/34 of the Indian Penal Code, pending in the court of Smt. Vidyawati Kumari, learned S.D.J.M., Khunti. During the intervening night of 20/21.06.2024, Karra police apprehended this petitioner along with co-accused persons while they were decamping away with Maruti Omni car after committing theft of batteries from Tower of B.S.N.L. It appears that vehicle on which the accused persons were travelling, was also stolen one. It was submitted that petitioner was not apprehended at the spot. It was further submitted that name of the petitioner has come in confession of co-accused Zakir Ansari who was apprehended at the spot. Learned A.P.P. has opposed the prayer for bail and submitted that petitioner is accused as many as 12 criminal cases.
Considering the fact that apart from confession, there is no other material against the petitioner on the record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Smt. Vidyawati Kumari, learned S.D.J.M., Khunti or her successor, in connection with Karra P.S. Case No.59 of 2024, corresponding to G.R. Case No.426 of 2024.
