239 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-27585-2022 (O&M) Date of Decision: 17-07-2025 Nirvail Singh ........Petitioner(s) Versus State of Punjab ........Respondent(s) CORAM: HON'BLE MR. JUSTICE ANOOP CHITKARA Present: Mr. Karanjit Singh, Advocate for the petitioner(s). Mr. Jasdev Singh Thind, DAG, Punjab. Mr. B.S. Jaswal, Advocate for the complainant. *** ANOOP CHITKARA, J. (Oral) FIR No. Date Police Station Sections 117 1.5.2021 Lopoke, District Amritsar 302, 148, 149 IPC, Section 506 IPC (added later on) and Sections 25/27 Arms Act, 1959. 1. The petitioner incarcerated in the FIR captioned above came before this Court under Section 439 CrPC, seeking regular bail. 2. After arguing for a considerable time, petitioner’s counsel submits that since the petitioner is already in custody for more than 4½ years, he would be contended and satisfied if, as a special case, the trial Court is directed to expedite the trial. 3. There can be no objection to the prayer made by the petitioner either by the complainant or the State. 4. Given above, although this Court is well aware that it is not for this Court to interfere in the docket of the trial Court, but considering the massive pre-trial custody and being an exceptional case, the trial Court is directed to take up necessary steps to complete the trial on or before 24.12.2025. It is clarified that in case the other accused who are on bail in this FIR try to delay the trial, trial Court shall proceed further by cancelling their bail and in case the delay is at the instance of the petitioner, the time for concluding the trial may be extended. ASHWANI KUMAR 2025.07.29 12:14 I attest to the accuracy and integrity of this order/judgment Punjab & Haryana High Court, Chandigarh CRM-M-27585-2022 -2- 5. Liberty is also reserved to the petitioner to file an application for expediting the trial in cross complaint case before the Sessions Court and if still aggrieved, also before this Court. 6.
