JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.276/2025 of Bommanahalli Police Station registered for offences punishable under Sections 61, 69, 77, 318(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023. - 3 - HC-KAR NC: 2025:KHC:48545 CRL.P No. 14674 of 2025 2. Heard learned counsel for petitioner and learned High Court Government Pleader for respondent - State. 3. Learned counsel for petitioners would contend that, the petitioner and the victim girl were residing in a rented house under live-in-relationship. The victim girl is aged twenty seven (27) years and she had married a person and subsequently, she divorced him and was residing with this petitioner. The petitioner has not refused to marry the victim girl. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The offence alleged against this petitioner is not punishable either with death or imprisonment for life. With these, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader for respondent would contend that, the statement of the victim girl has been recorded under Section 183 of BNSS wherein, she has stated the acts of this petitioner cheated her and having sexual intercourse under the - 4 - HC-KAR NC: 2025:KHC:48545 CRL.P No. 14674 of 2025 promise of marriage. The charge sheet materials show that, there is a prima-facie case against this petitioner for offences alleged against him. With these, he prayed for dismissal of the petition. 5. Having heard the learned counsels appearing for parties, the Court has perused the charge sheet and other materials placed on record. 6. As per the charge sheet, the accusation against this petitioner is that, he was residing with the victim girl in a rented house and had sexual intercourse for more than twenty five times from March, 2025 to 17.08.2025 and recorded the said private acts in the mobile. When the victim girl asked him to marry her and he has stated her to wait for some time and he will convince his family members. The victim girl is aged twenty seven (27) years and she is of age of understanding the consequences of her acts. The offence alleged against this petitioner is not punishable either with death or imprisonment for life. As the charge sheet is filed, the petitioner is not required for - 5 - HC-KAR NC: 2025:KHC:48545 CRL.P No. 14674 of 2025 custodial interrogation. The petitioner is in judicial custody since 22.09.2025. There are no criminal antecedents of the petitioner. 7. Considering all the above aspects, the petitioner has made out a case for grant of bail conditions. In the result, the following; ORDER The Criminal Petition is allowed. The petitioner/accused No.1 is granted bail in Crime No.276/2025 of Bommanahalli Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like- sum to the satisfaction of the trial Court. ii) The Petitioner shall not tamper the prosecution witnesses either directly or indirectly. - 6 - HC-KAR NC: 2025:KHC:48545 CRL.P No. 14674 of 2025 iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for the speedy disposal of case.
