Surajpur Chhattisgarh ... Applicant versus State of Chhattisgarh through the SHO Jhilmili Distt. Surajpur (C.G.) ... Respondent For the applicant : Mr. Dheerendra Pandey, Advocate For the State : Mr. H.A.P.S. Bhatia, Panel Lawyer (Hon’ble Shri Justice Sanjay Kumar Jaiswal) Order on Board 12.11.2025 1. This is second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 55 of 2024 registered at Police Station Jhimili, District Surajpur (C.G) for the offence punishable under section 302 of IPC. 2. The first bail application i.e., MCRC No.2592/2025 has been dismissed on 23.06.2025 after hearing it on merits. 3. The prosecution story in brief is that on 07.05.2024, the applicant gave merg intimation that his wife having suffered chest and stomach pain was brought to the hospital and when the deceased reached hospital, she was declared dead. During postmortem, it was ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2025.11.13 14:05:51 +0530 2 revealed that the death was homicidal in nature. During investigation, the police found that the applicant has committed murder of his wife by strangulating with a scarf, on which, FIR was registered against him for the offence u/s 302 IPC. 4. Learned counsel for the applicant submits that there is no direct evidence available to connect the accused in crime in question and merely on suspicion, he has been arrested. He submits that out of total 26 witnesses, only 12 have been examined till date and the applicant is in jail since 08.05.2024 and there is no possibility of early disposal of case, therefore, he may be enlarged on bail. 5. Per contra, learned State Counsel opposes the bail application and submits that the trial is in progress. He refers to the statement of doctor (P.W.12) and submits that as per the postmortem report the death was homicidal in nature and there was a scratch mark on the neck of deceased. 6. Having considered the submissions made by learned counsel for the parties and the statement of doctor (P.W.12), I do not find any changing circumstances after rejection of the first bail application. Consequently, the second bail application is rejected. 7. However, looking to the long custody period of the applicant the trial Court is directed to expedite and conclude the trial as early as possible preferably within a period of 4 months from the date of receipt of copy of this order. 8. Copy of this order be sent to the trial Court for information. Sd/- (Sanjay Kumar Jaiswal) Judge Rao
