PUBLIC PROSECUTOR The Court Made the following: COMMON ORDER: The instant petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioners / Accused Nos.1 to 5, seeking to quash the proceedings against them in C.C.No.408 of 2023 on the file of the learned Judicial Magistrate of First Class, Rajampet. 2. I.A.Nos.1 and 2 of 2025 are filed by Respondent No.1 seeking permission to compound the offences and to record the compromise between her and the Petitioners. 3. Petitioners/A1 to A5 and Respondent No.1 appeared before this Court and were identified by their respective learned counsel. Copies of their Aadhar cards attested by their respective counsel are filed for proper identification. 4. Learned Assistant Public Prosecutor is in attendance. 5. Both parties would submit that they came to an amicable settlement at the intervention of their elders and well wishers. Learned counsel for the petitioners prays to allow the petition by exercising the inherent jurisdiction under Section 528 of BNSS. 6. It is submitted by Respondent No.1 that she has received an amount of Rs.20,00,000/- (Rs.10,00,000/- by way of cash and Rs.10,00,000/- by way of demand draft). Accused No.1 has agreed to pay 3 the remaining amount of Rs. 10,00,000/- at the time of obtaining divorce by mutual consent. Respondent No.1 has represented before this Court that she has no objection to her husband visiting the child, presenting gifts, and taking the child for some time on any auspicious occasions. 7. Considering the submissions, in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between them, I.A.Nos.1 and 2 of 2025 are allowed. Consequently, the Criminal Petition is allowed and the case against the Petitioners / Accused Nos.1 to 5 in C.C.No.408 of 2023 on the file of the learned Judicial Magistrate of First Class, Rajampet, is hereby quashed.
