This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioner for the following relief:
“ ... to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents 2 to 4 in not taking action by registering my complaint dt.26-03-2024 against the respondents 5 and 6 as wholly illegal, arbitrary and unjust and consequently direct the respondents 2 to 4 to register petitioner's complaint dt.26-03-2024 and take appropriate action in accordance with law in the interest of justice and to pass ...”
Heard learned counsel for the Petitioner and Learned Assistant Government Pleader for Home representing for respondent State. Perused the material on record.
Learned Assistant Government Pleader placed on record, the written instructions and would submit that Petitioner lodged a complaint before respondent No.4 against his brother, entered in the GD on 26.03.2024, during preliminary enquiry, it revealed that there are civil disputes pending between the parties and police never interfere in the civil dispute and requested to dispose of the Writ Petition by passing appropriate orders.
Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of.
In that view, this Writ Petition is allowed. Petitioner is at liberty to work out the remedy before appropriate forum according to law. No order as to costs. Pending applications, if any, shall stand closed.
