1. Heard on I.A. No.1/2025, application seeking condonation of delay.
2. On due consideration and for the reasons assigned in the application, the same is allowed. Delay of 503 days in filing the MCC is condoned.
3. This MCC has been filed seeking restoration of M.A. No.12/2024 for referral to mediation in compliance of Hon’ble Supreme Court’s Order in SLP(C) No.53485 of 2024 dated 02.05.2025.
4. Relating to the issue, the Supreme Court, vide judgment and order dated 02.05.2025, held as follows:
“If such an application is filed, the High Court may refer the parties for mediation so that there could be an amicable settlement with regard to the rate of interest that is applicable between the parties.”
5. In view of the aforesaid order and for the reasons mentioned in the application to restore M.A. No.12/2024, the same is restored for hearing to the extent of Hon’ble Supreme Court order dated
02.05.2025.
