JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2025:KHC:35483 WP No. 26762 of 2025 ORAL ORDER The first petitioner is the owner of property in No. 315, 6th Cross, 1st B Main Road, 9th Block, 2nd Phase, Nagarbhavi, Vinayaka Layout, Bengaluru [the subject property]. The petitioners are aggrieved by the notice dated 25.08.2025 [Annexure - A] issued by the first respondent, and this respondent has issued this notice calling upon the petitioner to produce documents to verify that the construction is in accordance with the plan. Mr. S. Sreevatsa, the learned Senior counsel for the petitioner, submits that though the notice was issued no proceedings have been conducted on 02.09.2025 and that this Court may dispose of the petition observing that the petitioner is at liberty to produce documents with the first respondent. The learned Senior counsel also submits that if there are - 4 - HC-KAR NC: 2025:KHC:35483 WP No. 26762 of 2025 pending proceedings, the first respondent must take action subject to the outcome in such proceedings. Mrs. K. P. Yashodha, the learned Additional Government Advocate for the respondents, is heard and this Court disposes of this petition with liberty to the petitioner to respond to notice and without prejudice to prosecute any pending proceedings or proceedings that may be contemplated under Section 248 of the Bruhat Bengaluru Mahanagara Palike Act, 2020.
