This application has been filed by the applicant for quashing the impugned charge sheet no. 217 of 2024 dated 07.06.2024 and entire proceeding of Case No. 19244 of 2024 (State Vs. Monu Sharma & others) arising out of Case Crime No. 058 of 2024, Police Station Kotwali Dehat, District Bulandshahar based on the impugned charge-sheet, presently pending in the court of Chief Judicial Magistrate, Bulandshahar, under Sections 419, 420, 467, 468, 471, 120-B I.P.C. and the order dated 06.11.2024 passed by Chief Judicial Magistrate, Bulandshahar, by which the Magistrate has taken cognizance and issued process against the applicant to face trial under Sections 419, 420, 467, 468, 471, 120-B I.P.C. 3. After some arguments, learned counsel for the applicant prays that the applicant may be permitted to move appropriate application before the Court concerned as provided under Section 250(2) of the BNSS. 4. This prayer has not been opposed by the learned A.G.A. 5. Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously. 6. For a period of 30 days, no coercive action will be taken against the applicant. 7. With the above observations, the application stands disposed of.
