Petitioner’s husband, an Assistant Teacher, was suffered with an order dated 03.08.2016, whereby his salary was stopped for certain period. However, there is no material on record that petitioner’s husband has challenged the said order during his life time and even after his retirement (retired on 31.03.2017) and till he died on 12.09.2020. 3. Petitioner has earlier approached this Court with a prayer to grant death cum retiral benefits and pension. No prayer was made with regard to payment of stopped salary. However, it appears that in the application filed by petitioner prayer for same was also made. 4. In aforesaid circumstances, impugned order was passed whereby due to above referred order dated 03.08.2016 salary for said period was not paid. Relevant part of impugned order dated 28.09.2024 is reproduced hereinafter: "खण्ड शशिकक्षा अधधिकक्षाररी म्ययोरपपुर सयोनभद्र दक्षारक्षा शशिकककों कके शनयशमित वकेतन (स्व० डक्षाक्टर समम्मिधलित) भपुगतक्षान शबिलि अधियोहस्तक्षाकररी कक्षायक्षार्यालिय कयो प्रस्तपुत करनके कके उपरक्षान्त मिक्षाह फरवररी 2016 तक कके वकेतन भपुगतक्षान शकयक्षा जक्षा चपुकक्षा हहै। कक्षायक्षार्यालिय धजलिक्षा बिकेधसक शशिकक्षा अधधिकक्षाररी सयोनभद्र दक्षारक्षा शनगर्यात वकेतन अवरुद्ध आदकेशि शदनक्षानांक 03.08.2016 अद्यतन प्रभक्षावरी हयोनके तथक्षा खण्ड शशिकक्षा अधधिकक्षाररी म्ययोरपपुर सयोनभद्र दक्षारक्षा शबिलि प्रस्तपुत नहरी करनके कके कक्षारण यक्षाचरी कके पशत स्व० डक्षाक्टर कके मिक्षाचर्या 2016 सके सकेवक्षाशनववृत्त शतधथ 31.03.2017 तक कक्षा वकेतन भपुगतक्षान शकयक्षा जक्षानक्षा सम्भव नहहीं हयो सकक्षा। यक्षाचरी दक्षारक्षा अवशिकेष वकेतन मिक्षाह नवम्बिर 2014 सके शदनक्षानांक फरवररी 2016 तक कके भपुगतक्षान ककी मिक्षानांग शकयक्षा जक्षानक्षा शनरक्षाधिक्षार हहै। यक्षाचरी कके पशत स्व० डक्षाक्टर कक्षा अवरूद्ध वकेतन धजलिक्षा बिकेधसक शशिकक्षा अधधिकक्षाररी, सयोनभद्र दक्षारक्षा बिहक्षालि शकयके जक्षानके कके उपरक्षान्त मिक्षाह मिक्षाचर्या 2016 सके सकेवक्षाशनववृत्त शतधथ 31.03.2017 तक कके वकेतन भपुगतक्षान कके सम्बिन्धि मिम अगकेतर कक्षायर्यावक्षाहरी सपुशनमशचत कर लिरी जक्षायकेगरी। अस्तपु यक्षाचरी शरीमितरी धिनकेसरक्षा दकेवरी पत्नरी स्व० डक्षाक्टर दक्षारक्षा अधियोहस्तक्षाकररी कक्षायक्षार्यालिय कयो प्रस्तपुत प्रत्यक्षावकेदन शदनक्षानांक 08.08.2024 कयो एतददक्षारक्षा शनस्तक्षाररत शकयक्षा जक्षातक्षा हहै।" 5. Learned counsel for petitioner submits that at this stage, it would be difficult for petitioner to state that whether said order was challenged by her husband or not and whether he was aware of it or not. Since petitioner has not asked for a copy of said order dated 03.08.2016 from concerned respondent as well as no averment is made in this writ petition, therefore, learned counsel fairly submits that this writ petition may be disposed of with liberty to petitioner that he may ask the concerned respondent to supply copy of said order dated 03.08.2016, so that further recourse may be taken. 6. Learned counsel appearing for Respondents-2 and 3 submits that probably petitioner has no right to challenge the said order, however, she fairly submits that copy of said order be supplied to petitioner if an application is made in this regard. 7.
