This is an application filed U/s 482 Cr.P.C. for quashing the criminal proceeding of case no. 286 of 2019 arising out of case crime no. 4 of 2019 (State vs. Brijendra and Ors) under Section 498A, 323, 504, 506 IPC read with section 3/4 D.P. Act, P.S. Mahila Thana, District Basti pending in the court of ACJM, 3 Basti and charge sheet dated 30.05.2019. 3. Learned counsel for the applicants has invited the attention of the court towards supplementary dated 04.06.2024 so as to content that on 06.12.2023, parties of late have entered into compromise and the same has been filed before the court of FTC Mahila Apradh CAW Basti, in case crime no. 286 of 2019, under section 498 A, 323, 504, 506, 406 IPC read with section 3/4 of D.P. Act, documents whereof is annexure S.A.-I at page 8 reference has been made in paragraph-4. Learned counsel for the applicants submits that direction be issued for verification and in the meantime interim protection be accorded. 4. Learned AGA, has no objection to the same. 5. Considering the said submission, the application stands disposed of directing the applicants to appear before the court below by 09.05.2025 along with the self attested copy of the present application, certified copy of the order and supplementary affidavit. On the receipt of the same, the court below shall make endeavour to put to notice the other party and thereafter verify the compromise application as alleged to have been filed by the applicants within two months. 6. Till the verification is done in the compromise application so submitted by the parties, no coercive action shall be taken against the applicants in the proceedings of Criminal Case No. 286 of 2019 arising out of case crime no.4 of 2019 (State vs. Brijendra and Ors) under Sections 498A, 323, 504, 506, 406 IPC read with section 3/4 D.P. Act P.S.Mahila Thana District Basti pending in the Court of Additional Chief Judicial Magistrate, court no.3 Basti. The protection accorded to the applicants is only available subject to compliance of the terms and conditions and timeline as provided herein and in case of default, the order shall stand vacated without reference to the Bench.
