THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION NO: 30822 of 2025 ORDER:
This writ petition is filed under Article 226 of the Constitution of the India seeking the following relief:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos.3 to 5 to conduct afresh survey on 31.10.2025 as illegal”. 2. The contention of the petitioner is that, earlier, based on the application filed by the petitioner and others, the respondent authorities have not conducted survey as per the rules, hence, they constrained to file a writ petition W.P.No.16995 of 2025, the said Writ Petition was disposed of vide order dated 23.07.2025 directing the respondent authorities to conduct survey in an extent of Ac.15.92 cents in Sy.No.132, situated at D.Cherlopalli village, Bathalapalle Mandal. Accordingly, the 2nd respondent issued notice on 12.09.2025 to the petitioner and conducted survey on 19.09.2025. Despite the completion of the said survey and demarcation process, the survey report has not been furnished to the petitioner. Now, surprisingly, again, they have issued notice on 31.10.2025 for conducting fresh survey, which is scheduled to be conducted on 07.11.2025 i.e., today. Aggrieved by the same, the present writ petition has been filed. 4

The learned counsel for the petitioner submits that earlier the respondent authorities conducted survey, but they have not chosen to give report/endorsement for the reasons best known to the respondent authorities. Now with a malafide intention, again, they have issued notices to conduct survey. 4. When the second resurvey is scheduled to today, the petitioner may participate in the survey and file his objections and after completion of survey, the respondent authorities ought to have given the survey report/ endorsement to the petitioner. In the said circumstances, if the respondent authorities have conducted the survey, which is scheduled to today, they may complete the survey and if any objections are filed by the petitioner, the same may be considered and issue endorsement to that effect, strictly, within a period of one month. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel miscellaneous applications, pending, if any, shall also stand closed.
