Neutral Citation No. - 2025:AHC:74260 Court No. - 66 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 14563 of 2025 Applicant :- Neelu Singh Opposite Party :- State of U.P. Counsel for Applicant :- Mahendra Bahadur Singh,Rishabh Singh,Shashank Singh Counsel for Opposite Party :- G.A. Hon'ble Sameer Jain,J.
1. Heard Sri Mahendra Bahadur Singh, learned counsel for the applicant and Sri Imran Khan, learned AGA, for the State. 2. The instant bail application has been filed on behalf of the applicant with the prayer to release her on bail in Case Crime No.15 of 2025, under Sections 103(1) and 238(a) BNS, Act, Police Station Koraon, District Prayagraj during pendency of the trial. 3. Learned counsel for the applicant submits that applicant is the mother-in-law of the deceased and as per allegation she along with her son, i.e., husband of the deceased committed the murder of her daughter-in-law but entire allegations made against her are false. 4. He further submits that there is no cogent evidence which can show that applicant involved in the present crime. 5. He further submits that deceased was mentally sick lady and when she disappeared from her maternal home then an information in this regard was given to the Police from applicant side but after recovery of her dead body FIR of the present case was lodged. 6. He further submits that applicant is a lady and she is about 50 years old and she is not having any previous criminal history and
in the present matter she is in jail since 24.1.2025. 7. Per contra, learned AGA opposed the prayer for bail and submits that applicant is the mother-in-law of the deceased and dead body of her daughter-in-law was found outside the home and from the perusal of the post mortem report of the deceased it reflects that it is a case homicidal death. 8.
Learned AGA further submits that however, in pargraph-20 of the affidavit filed in support of the instant bail application applicant made an averment that the information of missing of the deceased was given to the Police but her averment is totally false and there is no evidence in this regard on record and this shows the conduct of the applicant and, therefore, considering the nature of allegation levelled against the applicant and the conduct of the applicant and her son, i.e., the husband of the deceased, she should not be released on bail. 9. I have heard learned counsel for the parties and perused the record of the case. 10. However, applicant is the mother-in-law of the deceased but allegations against her are quite serious and as per allegation she along with her son, i.e., husband of the deceased, committed the murder of her daughter-in-law. 11. Further, however, dead body of the daughter-in-law of the applicant was not found in her matrimonial home and it reflects that it was found in the field but from the post mortem report prima facie it appears to be a case of homicidal death. 12. Further, however, as per allegation, applicant's daughter-in- law was mentally unfit and she left her matrimonial home and
immediately thereafter an information in this regard was given to the police but no such evidence in this regard is on record which can suggest that information of missing of the deceased was given either by applicant or her son, i.e., husband of the deceased to the Police. Therefore, prima facie avement made in paragraph-20 of the affidavit filed in support of the instant bail application appears to be false. Considering this fact, this Court finds merit in the argument advanced by the learned AGA that the conduct of the applicant and her son, i.e., husband of the deceased does not appear to be proper and they failed to explain the homicidal death of the deceased. 13. Further, applicant in the present matter is in jail only since
24.1.2025. 14.
Therefore, considering the facts and circumstances of the case discussed above, in my view, applicant is not entitled to be released on bail at this stage. 15. Accordingly, the instant bail application is rejected. 16. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
