PUBLIC PROSECUTOR The Court made the following ORDER: This criminal petition has been filed, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking for granting of pre-arrest bail to the petitioners-accused Nos. 2 to 4 and 6 in crime No. 330 of 2025 of Proddatur Rural Police Station, Kadapa District, registered for the offences punishable under Sections 118 (1) and 351 (2) read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023. 2. Heard learned counsel for the petitioners-accused Nos. 2 to 4 and 6 and learned Assistant Public Prosecutor appearing for the respondent-State. 3. By common order dated 12-09-2025 in Criminal Petition Nos. 9000 and 9005 of 2025, this Court granted pre-arrest bail to the petitioners therein who are accused Nos. 2 to 5 and 7 to 13 in crime No. 331 of 2025 of Proddatur Rural Police Station. That crime was registered at the behest of one of the accused in the present crime. Accused Nos. 1, 8 and 11 were already enlarged on regular bail by order dated 22-09-2025 in Criminal M.P.No. 282 of 2025 on the file of the Court of learned II Additional District and Sessions Judge, Kadapa at Proddatur. As per the case of prosecution, L.W.2 suffered grievous injuries. The other three victims suffered simple injuries. So far, five 3 witnesses are examined. There are omnibus allegations levelled against the petitioners-accused Nos. 2 to 4 and 6 who are permanent residents of Proddatur Mandal, Kadapa District. They have got fixed abode. There is a case and counter case lodged by the group of the petitioners and accused and other persons. 4. Considering the facts and circumstances of the case and the nature and gravity of allegations levelled against the petitioners-accused Nos. 2 to 4 and 6, this Court is inclined to grant pre-arrest bail to them with the following stringent conditions: (i) In the event of arrest, the petitioners-accused Nos. 2 to 4 and 6 shall be enlarged on bail subject to their executing each a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of arresting officials; (ii) The petitioners-accused Nos. 2 to 4 and 6 shall appear before the Station House Officer concerned on every Saturday in between 10:00 am and 05:00 pm till filing of charge sheet; (iii) The petitioners-accused Nos. 2 to 4 and 6 shall make themselves available for investigation as and when required; 4 (iv) The petitioners-accused Nos. 2 to 4 and 6 shall not cause any threat, inducement or promise to the prosecution witnesses; (v) The petitioners-accused Nos. 2 to 4 and 6 shall surrender their passports, if any, to the investigating officer. If they claim that they do not have passport, they shall submit affidavits to that effect to the Investigating Officer; and (vi) The petitioners-accused Nos. 2 to 4 and 6 shall not leave the limits of State of Andhra Pradesh without the express permission from the Station House Officer concerned. 5.
