This criminal misc. application is filed under Section 528 of B.N.S.S. by the petitioner/accused for quashing of the order dated 14.03.2022 (Annexure No.1) passed in Criminal Appeal No. 76 of 2021, pending before the court of First Additional Sessions Judge, Roorkee, District Haridwar and further to quash all the subsequent orders passed in the above Criminal Appeal after the order dated 14.03.2022, whereby the proceedings under Sections 82 & 83 of Cr. P.C., issuance of NBW and notices to the sureties were initiated. 3. After arguing at length, learned counsel for the petitioner/accused seeks permission to withdraw the present petition with liberty to file an application for cancellation of the NBW issued by the Appellate Court. 4. In view of the above, the present petition is dismissed as withdrawn with liberty to file an application for cancelling the NBW issued by the Appellate Court and same shall be decided by the court, as per law.
