INDIRESH ORAL ORDER This petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking to appoint Hon'ble Mr. Justice V. Jagannathan, Former Judge of this Court or any other suitable person as sole Arbitrator with a direction to the Arbitrator to be appointed by this Court to arbitrate the dispute between the petitioner and respondents in terms of clause 16 of the Franchise Agreement dated 25th September, 2019 (Annexure-C). 2. Heard Miss. Aathira Menon, learned counsel on behalf of Sri. Vikram Unni Rajagopal, appearing for the petitioner. Respondents are served and unrepresented. 3. Having taken note of the submission made by learned counsel appearing for the parties and on perusal of the clause 16 of the Franchise Agreement dated 29th September, 2019 (Annexure-C), I am of the view that, retired District Judge - 3 - HC-KAR NC: 2025:KHC:35382 CMP NO.69 OF 2025 be appointed as sole Arbitrator to resolve the dispute between the parties. 4. Therefore, Sri. D.R. Venkatasudarshana, District Judge (retired) is appointed as Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation Centre (Domestic and International), Bengaluru. 5. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 6. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic and International), Khanija Bhavan, Bengaluru for proceeding further in the matter. 7. Registry is directed to return the original documents if any, produced by the parties, after obtaining photostat copy of the same for the file.
