This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.06/2025, registered at Police Station - Iragaon District - Kondagaon (C.G.) for the offence punishable under Sections under Sections 420, 467 & 468 of IPC. 2. As per the prosecution story in brief is that, it is alleged that one Jageshwari Mandawi who worked in Jamuna Swa Sahayta Samuh of Village Padde has withdrawn an amount of Rs. 4,00,000/- from the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.10.07 10:56:27 +0530
2 account of the Samuh in Chhattisgarh State Rural Bank Dhanora and on her arrest she disclosed that the said withdrawal slip has been filled by the applicant and the applicant also involved and also taken the half of amounts and based on that memorandum, the present applicant has also been implicated in the case. 3. The applicant is innocent and has been falsely implicated in the present case. She has not played any role in the alleged offence. The applicant was working as an FLCRP, whose duty was to assist villagers in filling out various forms and to make them aware of different government schemes and policies, and in the discharge of her duties, she only helped the villagers fill the forms without any knowledge of any fraud or cheating committed by the main accused persons. The applicant had earlier raised complaints regarding fraudulent activities in several Swa Sahayta Samuhs, due to which the said groups have falsely implicated her out of malice. The amount in question has neither been withdrawn by the applicant nor received by her, even as per the prosecution’s case. The applicant is a lady who has recently delivered a one-month-old child and is the sole earning member of her family, therefore, he prays for grant of anticipatory bail to the applicant. 4.
On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, this Court, without expressing any
3 opinion on the merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Smt. Deveshwari Soni, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) she shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) she shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of hes adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) she shall not involve herself in any offence of similar nature in future. Sd/-
