This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents, more particularly Respondent Nos.
2 and 3, in interfering and causing hindrance to the day to day agricultural activities of petitioners and threatening to dispossess them from the lands totally admeasuring Ac.45.00 in Sy Nos. 676-5, 677 and 678 of Yallapeta Village, Srikurmam Post, Srikakulam District, as bad, arbitrary and violative of Arts. 14, 21 and 300-A of Constitution of India and to pass such other or further orders as are deemed fit and proper in the circumstances of the case and in the interests of justice.…”
2. Heard M/s. M.Vidyavathi, learned counsel for the petitioner and Sri P.AjayBabu, learned Assistant Government Pleader for Home. 3.
Learned counsel for the petitioner would submit that police are interfering in the day to day agricultural activities of the petitioner and threatening to dispossess the petitioner from the subject land.
4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that on the complaint made by respondent No.5, the petitioner was called to the police station for enquiry. He would further submit that, after preliminary enquiry, it is found that the subject matter is a purely civil in nature. He would further submit that the police are not interfering in the civil disputes between the parties.
4. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. No order as to costs.
