GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate Writ Order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the respondents more particularly the 3rd respondent herein in interfering with peaceful possession and enjoyment of house property of the petitioner house bearing D.No.3-9 situated in Sy.No.61 of Podagatlapalli Village, Ravulapalem Mandal, East Godavari District and in calling the petitioner to the police station without there being any complaint or report against the petitioner as arbitrary, illegal and consequently direct the 3rd respondent not to call the petitioner to the police station at the behest of the 4th respondent except in accordance with law and pass such other orders as may be deem fit and proper in the circumstances of the case.” 2. Heard Sri B.S.N. Naidu, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, relying upon the counter affidavit of respondent No.3, would submit that basing on the complaint of Smt. Kondiparthi Subbalakshmi, who is the wife of the petitioner herein, a crime has been registered against the petitioner in Crime No.305 of 2018 of Ravulapalem Police Station, for the offence punishable under Sections 447, 448, 427, 506 (2) r/w 34 IPC r/w 156(3) Cr.P.C. 4. Recording the submission made by the learned Assistant Government Pleader for Home, the Writ Petition is disposed of. However, the Police are directed to follow the due process of law relating to the case registered against the petitioner.
