JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed aggrieved by the order passed in I.A.No.3 in M.C.No.327/2018 dated 12.03.2025 by the III Addl. Principal Judge, Family Court, Bengaluru, whereby the Family Court had granted maintenance of an amount of Rs.15,000/- per month to the wife, the husband is before this Court. 2. On 01.08.2025, when this matter came up before this Court, an interim order was passed directing the husband to pay maintenance of an amount of Rs.5,000/- per month to the wife by 5th of every succeeding month and also shall pay the arrears at an amount of Rs.5,000/- within a period of eight weeks. - 3 - HC-KAR NC: 2025:KHC:35704 WP No. 23013 of 2025 3. Today, when the matter came up before this Court, learned counsel for the petitioner submits that he had filed a memo before the Family Court on 07.12.2024 and the Family Court by order dated 30.07.2025 has permitted the husband to withdraw the M.C., and as the main MC itself is withdrawn, nothing survives for consideration in this writ petition. 4. Having heard the learned counsel appearing the petitioner, perused the material on record. The Family Court had granted maintenance of an amount of Rs.15,000/- per month. The wife is entitled for maintenance of an amount of Rs.15,000/- per month from the date of application till the date the M.C. was dismissed as withdrawn i.e., 30.07.2025. Clarifying this aspect, this Court finds no further reasons to entertain this writ petition. Hence, this Court is passing the following: ORDER i. It is clarified that the wife is entitled for the maintenance of an amount of Rs.15,000/- per month from the date of application till 30.07.2025. - 4 - HC-KAR NC: 2025:KHC:35704 WP No. 23013 of 2025 ii. Accordingly, the writ petition is dismissed. iii. It is left to the respondent/wife to execute the order. iv. All I.As., in the writ petition shall stand closed.
