This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the parties and perused the records. 3. This application under Section 528 BNSS, 2023 has been filed by the Petitioner with a prayer for a direction to the trial court to consider the bail application of the Petitioner in connection with T.R.Case No.29 of 2024 arising out of Jeypore Sadar P.S.Case No.127 of 2024 on the file of the learned Sessions Judge-cum-Special Judge, Koraput at Jeypore. 4. Learned counsel for the Petitioner during course of argument submits that the Petitioner does not want to press this application with liberty to the Petitioner to raise all the grounds raised herein, at a later stage. Page 2 of 2. 5. Considering the submission made, this CRLMC stands disposed of as not pressed with liberty as prayed for. 6. Taking into consideration the submissions of the learned counsel for the Petitioner that the Petitioner is ready and willing to cooperate with the trial court for early commencement of trial, the Petitioner is directed to surrender before the learned Sessions Judge-cum-Special Judge, Koraput at Jeypore in T.R.Case No.29 of 2024 within three weeks from today. In the event the Petitioner surrenders and moves for bail within the aforesaid period, learned Sessions Judge-cum-Special Judge, Koraput at Jeypore in T.R.Case No.29 of 2024 shall do well to dispose of the bail application of the Petitioner on the same day on merit in accordance with law. The case diary be made available to the concerned court to facilitate disposal of the bail application of the Petitioner prior to the date of surrender. While considering the bail application of the Petitioner, the Court in seisin over the matter shall also keep in view the law laid down by the Hon’ble Supreme Court in Tofan Singh v. The State of Tamil Nadu, reported in (2013) 16 SCC 31 and pass necessary order. 7. Accordingly, the CRLMC is disposed of. Urgent certified copy of this order be granted on proper application.
