Neutral Citation No. - 2025:AHC:89815-DB Court No. - 21 Case :- WRIT - C No. - 17197 of 2025 Petitioner :- Rustam Ali And 13 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Om Narayan Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J. 1. The following prayer has been made in the writ petition: "i. Issue a writ, order or direction in the nature of certiorari quashing the impugned notification dated 01.03.2025 issued by the Ayodhya Development Authority, Ayodhya/respondent No. 3 (Annexure No. 5 to this writ petition). ii. Issue a writ, order or direction in the nature of mandamus restraining the respondents from proceeding further with the proposed acquisition and development process in respect of the petitioners' lands situated in Village Lalpur, Tappa Belwa, Tehsil Haraiya, District Basti." 2. The entire writ petition is based on a premise that the respondents are proposing to acquire the land, which is impermissible, as the land is situated in District Basti and could not be acquired by Ayodhya Development Authority, Ayodhya. 3. We have gone through the impugned notice. It states that under Mukhyamantri Shahri Vistarikaran Ewam Naye Shahar Protsahan Yojna, the Ayodhya Development Authority, Ayodhya is proposing to implement a scheme over 300 acres of land notified as 'development area'. In case, name of any person is not recorded in the revenue records, he may get his name recorded and inform the Authority, otherwise after expiry of one month, negotiation would be made for purchase of the land from the person whose name is recorded in the revenue records. 4. When we pointed out to learned counsel for the petitioners that the impugned public notice is only for getting the revenue records corrected, he prays for withdrawal of the writ petition with liberty to the petitioners to avail other appropriate remedy, as may be advised. 5. Accordingly, the writ petition stands disposed of as withdrawn with liberty in terms of the prayer made. Order Date :- 27.5.2025 Mukesh Kr. (Anish Kumar Gupta,J.) (Manoj Kumar Gupta,J.)
