GP FOR HOME The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 8932 of 2021 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declare the inaction of the 2nd respondent in granting permission to appoint Gunman by considering the application/representation dated 13.12.2017, 20.11.2018, 03.10.2019 and 16.01.2021 of the petitioner to protect his personal life and liberty as illegal, arbitrary, violative of Article 21 of constitution of India and consequently direct the 2nd respondent to accord permission to appoint a gunmen to the petitioner and pass.….” 2. Heard Sri Ravula Nagarjuna, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the petitioner was recognized as sajjadanasheen-cum-Muthawali of A.S. Peta Dargah. Because the petitioner got rivalry with family members and others, he wanted to engage a gunman to protect his life. 4. Learned Assistant Government Pleader for Home would submit that as per the intelligence input, there is no threat to the life of the petitioner. Learned Assistant Government Pleader for Home, by way of the counter affidavit, would submit that the request of the petitioner cannot be considered as there are three criminal cases pending against the petitioner vide Crime Nos.131/2014, 112/2018 and 99/2019 of A.S. Peta Police Station. 3 5. Learned counsel for the petitioner would submit that the petition may be disposed of by giving liberty to the petitioner to file a fresh writ petition as and when the cause of action arises. 6. Recording the said submissions, this Writ Petition is disposed of. However, Petitioner is at liberty to file a fresh writ petition as and when the cause of action arises. There shall be no order as to costs.
