ORAL ORDER

The petitioner, who was working as the Village Accountant at Tarikere Taluk, Chikkamagaluru District, is removed from service by the first respondent's order dated 06.04.2023 [Annexure-A18]. The petitioner has called this order in question with the Karnataka State Administrative Tribunal [for short, 'the Tribunal9] in Application No.3112/2023 [Annexure-A]. The Tribunal has allowed the application setting aside the first respondent's order dated 06.04.2023 but restoring the proceedings to the first respondent [the Disciplinary Authority] to conduct a fresh enquiry with due opportunity. The Tribunal has further observed that the enquiry proceedings must be completed within six months and that the petitioner is not entitled for reinstatement. - 4 -

It is now brought on record by Sri V. Shivareddy, the learned Additional Government Advocate, that the petitioner is served with Articles of Charge and the enquiry officer on completion of the enquiry has filed a report dated 30.10.2025.
When queried, the learned Additional Government Advocate submits that the first respondent will have to issue a second show cause notice to the petitioner with due opportunity to show cause against the findings of the report and further decision is subject to the Karnataka Civil Service (Classification, Control and Appeal) Rules, 1957 [for short, 'the CCA Rules']. When queried, Sri B.O. Anil Kumar, the learned counsel for the petitioner, submits that this Court could dispose of the petition without prejudice to the petitioner to show cause against the report and seek vindication of his case that there cannot be any punishment and that he is entitled to all benefits under the CCA Rules for the period between

06.04.2023 and the decision on the enquiry that is instituted. This Court is of the opinion that this petition must be disposed of leaving open all grounds that would be available to the petitioner including the benefits that should be if there is any order other than dismissal from service.
