This criminal misc. application is filed under Section 528 of B.N.S.S. by the petitioners/accused for quashing the impugned Chargesheet No.01/2020 dated 29.12.2020 (arising out of FIR No.408/2020) under Section 147, 148, 323, 504, 325 of IPC, registered at Police Station Sitarganj, District Udham Singh Nagar, impugned cognizance/summoning order dated 12.07.2021 passed by Judicial Magistrate Khatima, District Udham Singh Nagar in Criminal Case No.714/21, “State of Uttarakhand Vs. Nafees Ahmad and others” as well as entire proceedings of Criminal Case No.714/21, “State of Uttarakhand Vs. Nafees Ahmad and others” pending before Judicial Magistrate, Sitarganj, District Udham Singh Nagar qua the petitioners, in view of the compromise arrived at between the parties. 2. In view of the fact that a Compounding 1 2025:UHC:3364 Application was filed by the parties before this Court, this Court vide order dated 22.04.2025 had directed the parties to appear before the Secretary, DLSA, Udham Singh Nagar in order to get their statements recorded and to verify the compromise deed. 3. Pursuant to such order, the Secretary, DLSA, Udham Singh Nagar has submitted his report dated 24.04.2025 which clearly indicates that the parties have settled the dispute amicably and have also verified the contents of the compromise. 4. In view of the above, Compounding Application (IA No.1 of 2025) is allowed. As a consequence thereof, the entire proceedings of Criminal Case No.714/21, “State of Uttarakhand Vs. Nafees Ahmad and others” pending before Judicial Magistrate, Sitarganj, District Udham Singh Nagar are hereby quashed qua the petitioners. 5.
