1. This matter is taken up through Hybrid mode.
2. On perusal of order dated 04.07.2022 at Anneuxre-2 it appears that the present Petitioner-accused was earlier released on bail with a condition to appear before the learned trial court on each and every date fixed. An application under Section 317 of Cr.P.C. has filed on behalf of the Accused-Petitioner which was rejected in terms of
order passed by this Court by releasing the petitioner on bail. Thus, it was observed by the learned trial court that the accused had violated the condition imposed by this Court. Hence the time petition was rejected. Accordingly, vide order dated 04.07.2022 a NBW has been issued against the petitioner. In such view of the matter, this Court is of the view that the learned trial court has not committed any illegality in issuing the NBW against the petitioner vide order dated 04.07.2022.
3. However taking into consideration the fact that the petitioner
Page 2 of 2. is ready and willing to cooperate with the trial this Court grants liberty to the petitioner to surrender before the learned trial court below and move an application for bail. In such eventuality, the application filed by the petitioner shall be disposed of on very same day keeping in view that the fact that he was already released on bail. In the event the learned trial court is inclined to release the petitioner on bail then necessary stringent conditions may be imposed to ensure the appearance of the petitioner before the learned trial court.
4. With the aforesaid observations, the CRLMC stands disposed of.
