ALOK MAHRA 10th June, 2025 Writ Petition (M/B) No.155 of 2025 Usha Breco Limited and Another -- Petitioners Versus State of Uttarakhand and others -- Respondents With Writ Petition (M/B) No.165 of 2025 With Usha Breco Limited and Another -- Petitioners Versus State of Uttarakhand and others -- Respondents ---------------------------------------------------------------------- Presence:- Mr. Navneet Kaushik, learned counsel for the petitioners. Mr. B. S. Parihar, learned Addl. C.S.C. with Ms. Rajni Supyal, learned Brief Holder for the State. Mr. Sandeep Kothari, learned counsel for respondent nos.2 & 3/ Nagar Nigam Haridwar. --------------------------------------------------------------------- JUDGMENT : (per Mr. G. Narendar, C. J.) Learned counsel for respondent nos.2 & 3/ Nagar Nigam, Haridwar submits that order has been passed by the competent authority, cancelling the tender process. He would submit that order has been passed yesterday and that he has been instructed to submit so. 2025:UHC:4719-DB 2 2. In view of the submission made by the learned counsel for respondent nos.2 & 3, the instant writ petitions do not survive for consideration and have rendered infructuous. 3. Learned counsel for the petitioners makes a plea that the interim arrangement, which had enabled the petitioners to continue operating ropeway, be continued. 4. Petitions having been rendered infructuous, it would not be within the jurisdiction of this Court to extend the interim relief. Hence, reserving liberty to the petitioners to approach the competent authority to continue the interim arrangement, the writ petitions are disposed of. 5. Writ petitions are ordered accordingly. There shall no order as to costs. (G. NARENDAR, C. J.) (ALOK MAHRA, J.) Dated: 10.06.2025 BS
