By the present writ petition, the petitioner is questioning the order dated 13/12/2024 (Annexure P/1) passed by the SDO (Revenue), Arang, District Raipur whereby the proceeding under Section 40 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (for Short, “the Adhiniyam of 1993”) has been drawn and order of removal from the post of Sarpanch has been passed against the petitioner. 2. At the very outset, learned counsel for the respondents by raising objection submits that the order passed by the SDO is appealable under the Adhiniyam of 1993 and the same can be challenged before the concerned Collector. 3. In view of the submission made by the learned State counsel, learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the said impugned order dated 13/12/2024 (Annexure P/1) before the appellate authority. 4.
