Petitioner Bhavesh Puhal has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 10 dated 10.02.2025 under Section 64 of BNS 2023, registered at Police Station Naya Gaon, Mohali. 2. As per facts of case, prosecutrix gave her statement that she had studied up to 12th class from Government Senior Secondary School, Chandigarh and was doing domestic work. Bhavesh Puhal lived in her neighbourhood and became friendly with her in October, 2024. He stated that he liked her and wanted to marry her. On 09.02.2025 he told her that in case she wanted to marry him, then she should take her Aadhar Card. She took her Aadhar Card and accompanied him on his Activa bearing No.CH01-CQ-6169 and was brought to Naya Gaon. At about 04:00 PM, he took her to The King Hotel by saying that he had some work. When she resisted, he slapped her. Thereafter, she managed to escape and called her mother who reached the hotel. Bhavesh Puhal ran away leaving her alone in the hotel. Thereafter, the matter was reported to the police and present FIR was registered. 3. Learned counsel for petitioner argued that allegations levelled against him are false. The prosecutrix is a married lady, she herself is involved in criminal cases. She has lodged false complaints against others also and petitioner is also victim of the same. In pursuance of order dated 01.05.2025, petitioner has already joined the investigation and he is still ready to cooperate with the investigating agency. 4. Learned counsel representing State has filed status report, which is taken on record. It is confirmed that petitioner had joined investigation 21.05.2025 in compliance of the order passed by this Court. He was medically examined on 27.05.2025 at Civil Hospital, Kharar. After completion of investigation, challan will be presented in the court. Regarding alleged compromise (Annexure P-4), it is submitted that prosecutrix could not be contacted by the investigating agency, therefore, the same could not be verified. 5. I have considered the aforesaid factual position. Petitioner has joined the investigation and he is not required for any other purpose. It is pointed out that on completion of investigation challan will be presented in the Court. No purpose would be served by sending him behind the bars. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required.
