...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate writ, order or direction, more particularly a Writ in the nature of Mandamus, declaring the action of the respondents especially Respondent No 5 in calling the petitioners herein to the police station and interfering and forcing the petitioners to settle civil disputes by way of withdrawing the civil suit vide O.S No. 336 of 2022 on the file of Hon'ble Principal Junior Civil Judge, Kadiri and to act as per the terms of political leaders as being arbitrary, illegal and violation of Article 14, 19, 21 and 300-A of Constitution of India apart from violative of Principles of Natural Justiceapart from various judicial pronouncements of this Hon'ble Court as well as the Hon'ble Apex Court and consequently direct the Respondent No. 5 not to call the petitioners to the police station without there being any crime registered against the petitioners and not to interfere in civil disputes pending between petitioner and the revenue authorities and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the official respondents especially respondent no. 5 not to call the petitioners to the police station and harass the petitioners for settling the civil disputes pending between the petitioner and the revenue authorities and threatening the petitioners that they shall dispossess the petitioners from the lawful possession of their properties in Sy.No. 647-2 to an extent of
Ac.2.50 cents and Sy. No.640 to an extent of Ac.

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

2. Heard Ms Ayesha Azma, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned Assistant Government Pleader for Home on written instructions would submit that the on 28.10.2023, the 5th respondent received a representation from the Mandal Engineering Officer (Panchayat Raj Department) against the petitioner, the respondent-police called the petitioner for preliminary enquiry only. He further would submit that no crime has been
registered against the petitioner. He would further submit that the police are not interfering in the civil disputes between petitioner and the unofficial respondents.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
5. Recording the above said submission, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
