Heard learned counsel for the petitioner and perused the record. 2. The instant petition has been filed for following relief: "1 Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1 to decide the Execution Case No. 381 of 2023 (Misc. Case No. 381 of 2023) filed in Motor Accident Claim Petition No. 315 of 2000 (Raj Kumar Chaturvedi Vs. New India Insurance Company Ltd) pending before the respondent no. 1 Motor Accident Tribunal, Jhansi 23/09/st within a period of 1 month." 3. Contention of learned counsel for the petitioner is that pursuant to judgment and decree dated 12.05.2023, which has attained finality, the petitioner has filed an execution case in 2023 which is pending since then. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to respondent No. 1 to consider and decide the Execution Case no. 381 of 2023, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
