PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 11.09.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioners for grant of bail in connection with Buguda PS Case No.133 of 2025 corresponding to ST Case No.123 of 2025 pending in the file of learned Addl. Sessions Judge, Bhanjanagar, for commission of offences punishable U/Ss.126(2)/115(2)/118(1)/ 103(1)/191(2)/191(3)/190 of BNS, on the allegation of committing murder of deceased Balaram Nayak along with co-accused persons by assaulting him with sticks. 3. Heard, Mr. Sritam Kumar Mohanty, learned counsel appearing on behalf of Mr.Lambodor Achari, learned counsel for the petitioners and Mr. P.Satapathy, learned Additional Public Prosecutor in the present matter and perused the record. 4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 02.03.2025 with submission of charge sheet in the meantime and keeping in view the surrounding circumstance under which the transaction took place and taking into account the status of the petitioners as women and applying the first proviso appended to Sec. 480 of BNSS and the main allegation of hitting the deceased being directed against co-accused Babula Naik, this Court without expressing any view on merit admits the petitioners to bail. 5. Hence, the bail application of the petitioners stands allowed and the petitioners are allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6.
