ORAL ORDER
This petition is filed under Section 483 of BNSS praying to grant bail in Crime No.272/2025 of Bommanahalli Police Station registered for the offence punishable under Section 108 of BNS.
2. Heard learned counsel for petitioner and learned HCGP for respondent / State.
3. Learned counsel for petitioner would contend that petitioner, deceased and CW.8 were residing in a rented house. There were casual quarrel as the petitioner has sought financial assistance from the deceased. There was no any mens rea on the part of the petitioner to abate the deceased to commit suicide. Even though in the complaint

it is stated that physically assaulted deceased but the PM report does not contain any injuries on the dead body of the deceased. As the charge sheet is filed the petitioner is not required for custodial interrogation. With this he prayed to allow the petition.
4. Per contra, learned HCGP would contend that CW.8 is the eye witness to the incident who has stated in respect of quarrel between the petitioner and deceased. The acts of the petitioner amounts to abatement to the deceased to commit suicide. With this she prayed to reject the petition.
5. Having heard the learned counsels, the Court has perused the charge sheet and other materials placed on record.
6. As per the charge sheet, the case of the prosecution is that petitioner, deceased and CW.8 were residing in a rented premises and were working in the same company. The petitioner is stated to have sought

financial assistance from the deceased and quarreled with her and told that he will not marry her and abated the deceased to commit suicide. The acts of the deceased quarreling and telling the deceased that he will not marry her whether amounts to abatement to commit suicide is a matter of trial. The petitioner is in judicial custody since 15.09.2025 and as the charge sheet is filed, he is not required for custodial interrogation. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following:
ORDER
Petition is allowed. The petitioner is granted bail in Crime No.272/2025 of Bommanahalli Police Station, subject to following conditions: (i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/-

(Rupees one lakh only) with one surety for the like-sum to the satisfaction of the trial Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
