p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK WP(C) No.22383 of 2025 Siba Prasad Rout …. Petitioner Represented by Adv.- Mr. B. Pujari, Adv. -versus- State of Odisha & others …. Opposite Parties Represented by Adv.- Mr. D. Lenka, AGA. CORAM: JUSTICE DIXIT KRISHNA SHRIPAD ORDER 24.09.2025 Petitioner’s claim for heirship certificate was rejected by the Tahsildar vide order dated 21.09.2024 at Annexure-1. Petitioner’s statutory appeal against such rejection having been favoured, matter came to be remitted to the portals of the Tahsildar for consideration afresh vide order dated 21.02.2025 at Annexure-2. 2. Learned counsel for the petitioner submits that the claim is too short to be little and adjudication of the same after remand cannot be too long as if it is in the case of Kesavananda Bharati v. State of Kerala, (1973) 4 SCC 225. There is force in the submission. 3. Learned AGA Mr. Lenka, in all fairness, submits that he would instruct the Tahsildar-OP No.4 to accomplish the hearing & disposal of the matter after remand within a reasonable period, as may be fixed by this Court. However, he puts a caveat that all contentions should be kept open, and that a reasonable period be granted by the Court for such consideration. With this proposal, counsel for the petitioner is agreeable. Order No. 01. p. 2 In the above circumstances, petition is disposed off. Time for consideration is eight weeks and to inform the petitioner in writing the result of such consideration. All contentions are kept open. Now, no costs. Web copy of this order to be acted upon by all concerned. (Dixit Krishna Shripad) Judge Prasant
