As per instructions and the ratio of reservation applicable to the disabled person quota, the vacancies are available only in development block Bahadurpur and development block Kaptanganj, and there will be no vacancy as per the ratio at development block Ramnagar as number of vacancies sanctioned for the development block Ramnagar does make 4 percent quota available for disabled person, hence claim of the petitioner could not be considered for horizontal reservation in the disable person category. In view of instructions obtained, no relief can be granted to the petitioner qua claim of the petitioner for horizontal reservations. Petition is consigned to records.
