This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the Endorsement in Ref.B.704/2025, dated 26.09.2025 issued by 7th respondent, in response to my application submitted in R and R Grievance, dated 28.07.2025, thereby rejecting my eligibility for grant of R and R Package under 18 years completed category, alleging that myself, my father and my family members are not residing in China Ramanayyapeta Village three months prior to the cut-off date 13.08.2010 of publication of Preliminary Notification, though we are residing permanently in the same village till date, though the respondents acquired and utilized our Tiled House bearing D.No.1-218, situated in China Ramanayyapeta Village of Devipatnam Mandal in Alluri Seetharamaraju District (erstwhile East Godavari District) and Agricultural Landed Property admeasuring 0.615 Hectares in Survey No. 135/2, situated in Dandangi Village of Devipatnam Mandal in Alluri Seetharamaraju District (erstwhile East Godavari District) for the purpose of Polavaram Irrigation Project and in spite of the same respondents paid Compensation and allotment of house sites under Rehabilitation and Resettlement Packages to my father and sister in lieu of the aforesaid acquired properties, as illegal, irregular, arbitrary, violative of principles of natural justice, contrary to the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed thereunder, the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Rules, 2014 and offends Articles 14, 15, 16, 21 and 300-A of Constitution of India and consequently direct the respondents to grant R and R package to me together with all statutory benefits and pass….” 2. Today, when the matter is taken up for consideration, learned counsel for the petitioner and learned Government Pleader for Revenue collectively submitted that, the issue involved in this Writ Petition is squarely covered by the order of this Court dated 24.08.2021 in Writ Petition No.11333 of 2020 which is placed on record and prayed to pass order on the same lines. 3. Taking into consideration the submissions of both the learned counsel and following the above said order and for the reasons recorded therein, this Writ Petition also stands disposed of in terms of the order passed in Writ Petition No.11333 of 2020. 4. Accordingly, the Writ Petition is allowed, setting aside the endorsement issued by the 7th respondent dated 26.09.2025, and the 7th respondent is directed to pass a fresh reasoned order, within a period of three (03) months from the date of receipt of a copy of this order, after affording a reasonable opportunity of hearing to the petitioner and uninfluenced by any observations made herein. There shall be no order as to costs. 5. Registry is directed to append a copy of the order in Writ Petition No.11333 of 2020 to this order.
