By way of the present writ petition, the petitioner is aggrieved by the action on the part of the respondent No. 5 to 7 whereby the petitioner has been restraint from operating his small bricks factory which is Digitally signed by JYOTI JHA Date: 2025.10.14 16:51:02 +0530 2 situated at Village Machandur, Tehsil and District Durg (C.G.) and also aggrieved by the action of the respondent No. 2 where the representation of the petitioner dated 15.09.2025 has not been decided. 2. Learned counsel for the petitioner further submits that the background of the matter is that the petitioner belongs to poor background and he operates three small bricks factory at the government land situated at Village Machandur. Earlier the respondent No. 6 issued demolition notice to the petitioner on 05.06.2025 and directed to remove the bricks factory, subsequently the above notice was challenged by the petitioner before the Hon'ble High Court filing WPC No. 2951/2025 and the Hon'ble Court was pleased to stay the effect and operation of the demolition notice dated 05.06.2025 vide its order dated 17.06.2025, subsequently when the petitioner made attempt to operate his undemolished bricks factory and attempted to sale out the bricks the respondent No. 5 to 7 restrained the petitioner from operating the same and to sale out the bricks due to which the livelihood of the petitioner who is a poor villager is affected and thereafter as he has no source of earning he preferred an representation to the respondent No. 2 Collector on 15.09.2025 and prayed to allow the petitioner in operate the bricks factory, the said representation remain undecided and due to which the livelihood of the petitioner has been affected. Hence this petition 3. Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending representation, he is 3 having no objection to the limited prayer. The pending representation dated 15.09.2025 shall be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the concerned respondent No. 2 to consider/decide the representation of the petitioner dated 15.09.2025 (Annexure P-5) in accordance with law /rules /regulations. 6. Till the representation of the petitioner is decided by the respondent authorities, the petitioner shall be permitted to only sell bricks which have already been manufactured earlier for his livelihood. 7.
