Dharmendra S/o Late Radheshyam, Aged About 24 Years, R/o Nisuriyan Ka Pura, Police Station Hindauncity, District Karauli. (At Present Confined In Sub Jail Hindaun City). ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Timan Singh For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 18/02/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.13/2025 registered at Police Station Hindaun, District Karauli for the offences punishable under Sections 189(2), 140(3), 109(1), 121(1), 132, 127(2), 308(2), 308(6), 308(7), 324(5), 352 & 351(3) of BNS, 2023 and Section 3 of the Prevention of Damage to Public Property Act, 1984 (in short ‘PDPP’ Act). 2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. [2025:RJ-JP:7052] (2 of 3) [CRLMB-1565/2025] Learned counsel submits that there is dispute between the sister of petitioner Nos.2 & 3 and her husband. Counsel submits that alleged injured constable is friend of the husband of the sister of petitioner Nos.2 & 3 and he was making pressure upon the petitioners to withdraw the complaint filed by the sister of the petitioners. Counsel submits that injuries found on the person of the injured are superficial in nature. Petitioners are in custody since 05.01.2025 and trial will take considerable time in its conclusion. Further custody of the petitioners would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by learned counsel for petitioners. He submits that there is serious allegation against the petitioners as they hosted the injured and thereafter, he was brutally beaten up by them. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially the fact that all the injuries sustained by the injured are simple in nature as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is directed that accused-petitioners – (1) Amarsingh S/o Rambharosi, (2) Sunil S/o Late Radheshyam & (3) Dharmendra S/o Late Radheshyam shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty [2025:RJ-JP:7052] (3 of 3) [CRLMB-1565/2025] Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that each of them shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /28
