FOR THE ALLEGED OFFENCE P/U/S 427, 506, 504, 448, 307, 323 R/W 34 OF IPC PENDING ON THE FILE OF HON'BLE PRL.DISTRICT AND SESSIONS JUDGE AT DAVANAGERE. THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER Learned counsel for the petitioners, having advanced elaborate submissions, has drawn the attention of this Court to the fact that the petitioners themselves have sustained grievous injuries. It is urged that, notwithstanding this factual background, a false complaint has been lodged against them, culminating in the filing of a charge sheet. It is further pointed out that, though a crime was registered on the basis of the complaint lodged by the petitioners9 mother, the Investigating Officer, - 3 - HC-KAR NC: 2025:KHC:37274 CRL.P No. 9870 of 2024 without due consideration of the medical evidence, has arbitrarily filed a <B= report. 2. Be that as it may, the record indicates that during the course of investigation, the Investigating Officer has collected the wound certificates and statements of certain eye witnesses. Insofar as the 8B9 report filed on the complaint of the petitioners9 mother is concerned, the petitioners are at liberty to pursue appropriate remedies after its submission. However, in the present proceedings, there appears to be some material warranting continuation of the case against the petitioners. At this stage, learned counsel for the petitioners has sought leave to withdraw the petition. Recording the said submission, the petition stands dismissed as withdrawn.
