Order No.
ORDER(ORAL) 12.09.2025
01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Balliguda PS Case No.104 of 2025 arising out of CT Case No.85 of 2025 pending in the Court of learned Court of the Special Judge-cum-Addl. District and Sessions Judge, Balliguda for commission of offences punishable U/Ss. 20(b)(ii)(C)/29 of the NDPS Act, on the main allegation of financing illicit trade of Contraband Ganja. 3. Heard, Mr. Mahes Das, learned counsel for the petitioner and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record. 4. Bail plea of the petitioners was in fact opposed to by the learned Addl. Public Prosecutor by relying upon the recovery of 91Kgs 310Grams of Contraband Ganja from the co-accused persons; but fact remains
that neither any contraband article was recovered from the possession of the petitioners nor were they apprehended from the spot with the contraband article. It is, however, claimed that the petitioners are not having any criminal antecedent of similar nature. On careful consideration of the material placed on record, the only allegation against the present petitioners is for financing for illicit trade of contraband article. In such view of the matter, and taking into consideration the material placed on record, this Court considers that the petitioners have satisfied the conditions of Sec.37 of NDPS Act. 5. For the reasons stated hereinabove and taking into account pre-trial detention of the petitioner in custody since 16.07.2025, this Court without expressing any view on merit admits the petitioner to bail. 6. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. The aforesaid order is subject to verification of the criminal antecedent of the Petitioner(s) and in case any criminal antecedent of similar nature is found against any of them, the benefit of this order shall not be extended to such petitioner(s).
