The petitioners have taken out an application being CAN 1 of 2025 for correction of the plot number where pond has been referred to in the
order dated 19.07.2024. To that effect, petitioners have drawn the attention of the Court to page number 111 of the writ petition. I find that the pond is referred to as Plot No. 858. Inadvertently the Plot No. 856 has been scribed in the order dated 19.07.2024. Having considered that the same is a clerical error, I am of the view that the same should be correctly read as Plot No. 858 as referred to in the decree passed in Title Suit No. 275 of
2014. Accordingly, in the order dated 19.07.2024, the paragraph where the plot number Plot No. 856 is appearing should be read as follows :
“The respondent nos. 3 and 4, being the Superintendent of Police, Purba Medinipur and the Officer-in-Charge, Junput Coastal Police Station, Purba Medinipur are also directed to ensure that the private respondent no.5, namely, Adhir Kumar Samanta does not interfere with the possession of the petitioners in
2 respect of the said pond situated at Plot No. 858, Mouza Nayaput till disposal of the writ petition.”
Other portions of the order dated 19.07.2024 would remain unaltered. Let this order be treated as part and parcel of the order dated 19.07.2024. In view of the aforesaid, CAN 1 of 2025 is
disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
